This is a great article about how the new Department of Labor updates will affect independent contractors. They are really starting to crack down on this. If you hire or are an independent contractor, and are an integral part of the business, using employer tools and coming at employer specified times- Congratulations! You are now an employee and entitled to workers comp and benefits. Now, employers can skate by on this, until an independent contractor gets hurt on the job and files for workers comp.
